This Intellectual Property Claim Policy outlines our procedures for addressing notices of alleged copyright, trademark, or patent infringement occurring on our website.

1. Copyright Infringement & DMCA Notification

In accordance with the Digital Millennium Copyright Act (DMCA), if you believe that any material available on or through our platform infringes upon any copyright you own or control, you may submit a written notification containing the following information to our designated agent:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Specific identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with the exact URL(s) or locations of that material on our site so we can locate it.
  • Information reasonably sufficient to permit us to contact you, such as your physical address, telephone number, and an email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Trademark Infringement Claims

If you believe that a listing, product name, or content on Shirtcount infringes upon your registered trademark, please send a trademark claim to our support email. Your claim must include:

  • The trademark registration number and the country/territory of registration.
  • The name of the owner of the trademark.
  • A description of the product or content on our website you believe infringes upon your trademark, including direct links (URLs).
  • Proof of trademark ownership or authorization to act on the owner's behalf.

3. Counter-Notification Process

If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must be in writing and include the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which Shirtcount may be found, and that you will accept service of process from the person who provided the original infringement notification.

4. How We Handle Claims

Upon receiving a valid and complete infringement notice, Shirtcount will act expeditiously to remove or disable access to the allegedly infringing material. We will also make a good faith attempt to contact the party who submitted or listed the affected content so they have the opportunity to respond with a counter-notice.

5. Repeat Infringer Policy

In appropriate circumstances and in our sole discretion, Shirtcount reserves the right to terminate accounts, cancel outstanding transactions, or restrict access for users who are deemed to be repeat infringers of intellectual property rights.
