1. Notice of Infringement (Takedown Request)

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our site by submitting a written DMCA Notice of Alleged Infringement. Upon receipt of a valid Notice as described below, we will take whatever action, in our sole discretion, we deem appropriate, including the removal of the challenged content from the website.

2. Elements of a Valid Takedown Notice

To be effective, your written Takedown Notice must include substantially all of the following details:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the direct URL of the product page).
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Counter-Notification Procedure (Restoration Request)

If you receive notice that material you posted or purchased has been removed or disabled due to a copyright infringement claim, and you believe that the material is not infringing, or that you have the proper authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, you may send a written Counter-Notification to our Designated Agent.

5. Elements of a Valid Counter-Notice

To be processed, your Counter-Notification must be a written communication provided to our Designated Agent that includes substantially the following information:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, physical address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the original notification of the alleged infringement or an agent of such person.

6. Restoration of Disputed Material

Upon receipt of a valid written Counter-Notification, we will promptly forward a copy to the person who filed the original Takedown Notice. If the copyright owner does not file a lawsuit seeking a court order against the user within 10 to 14 business days of receiving the Counter-Notification, we are legally permitted to restore access to the disabled material or replace it on our site.

7. Repeat Infringer Policy

In accordance with the DMCA and other applicable federal laws, Shirtcount maintains a strict repeat infringer policy. We reserve the right, in our sole discretion, to terminate the accounts of any users, vendors, or system contributors who are repeatedly flagged or found to be violating the intellectual property rights of others.

8. Liabilities for False Claims (Section 512(f))

Please be aware that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing, or was removed or disabled by mistake or misidentification, may be held liable for damages. This includes attorney's fees and court costs incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by Shirtcount, who is injured by such misrepresentation.

9. Modifications and Policy Updates

We reserve the right to amend, alter, or update the terms of this DMCA Policy at any time without prior notice.
